TERMS OF SERVICE

1. Introduction
Welcome to Hams (“the App”). These Terms of Service (“Terms”) govern your use of the App operated by QIANKUN (“we,” “us,” or “our”).
By downloading, installing, or using the App, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not use the App.
2. Nature of the App
The App is a mobile browser and resource management utility.
- Tool Only: The App is a technical tool designed to assist users in browsing the internet and managing downloads. We do not create, host, upload, or maintain any content accessed through the App.
- User Responsibility: You acknowledge that you are solely responsible for the URLs you visit and the content you access or download.
3. Premium Services (VIP Membership)
We offer a “VIP Membership” subscription that removes restrictions and friction. If you choose to subscribe, the following specific terms apply:
- Subscription & Payment: Payments will be charged to your iTunes or Google Play account at confirmation of purchase. Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period.
- Instant Technical Privileges: VIP members enjoy permanent and instant access to premium features without the need to interact with advertisements:
- High Concurrency: Instant access to set up to 6 simultaneous download tasks.
- Ultra HD Resolution: Instant access to 4K/UHD video downloads.
- Enhanced Previews: Default access to large-size, high-quality preview images.
- Priority Access: VIP members enjoy priority processing and are not subject to standard daily usage caps applied to free users.
- Ad-Free Experience: VIP members are completely exempt from all third-party advertisements and ad-tracking.
- Refunds: All refund requests must be processed directly through the respective app store (Apple or Google) according to their refund policies.
4. Advertising & Incentives (For Free Users)
To maintain the free version of the App, we display third-party advertisements.
- Ad Display: By using the free version, you agree to receive advertisements.
- One-Time Ad Unlocks: We offer an optional “Watch to Earn” mechanism. Free users can voluntarily choose to watch a rewarded video ad to temporarily unlock premium features for a specific download task, including:
- Unlocking 4K Resolution for a single download.
- Unlocking Higher Concurrency (2-6 tasks) for the current session.
- Unlocking Large Preview Images for the current panel.
- Voluntary Interaction: You acknowledge that these interactions are voluntary and initiated by you to obtain these temporary technical benefits.
- No Interference: You agree not to use ad-blockers or other methods to interfere with the proper display of advertisements.
5. Service Limitations & Usage Rules
To ensure system stability and fair access for all users, we manage network resources according to the following principles:
- Fair Use Policy: While we strive to provide a seamless experience, we reserve the right to impose limits on the number of downloads or bandwidth usage for free users to prevent abuse and ensure service availability.
- Dynamic Quotas: The specific download limits (if any) are subject to change based on server load and operational costs without prior notice. VIP members are generally exempt from these standard caps.
- Success Rate: Due to complex anti-crawling technologies and DRM protections on third-party websites, we do not guarantee that every video or resource can be successfully sniffed or downloaded. Failure to download a specific file does not constitute a defect in the App.
- Format Restrictions: The App supports common media formats (e.g., .mp4, .m3u8). We do not guarantee support for proprietary or encrypted stream formats.
6. User Conduct
You agree strictly NOT to use the App to:
- Violate any applicable national or international laws or regulations.
- Access, download, store, or distribute illegal content, including but not limited to Child Sexual Abuse Material (CSAM), terrorism propaganda, extreme violence, or hate speech.
- Infringe upon the intellectual property rights of others (e.g., unauthorized downloading of copyrighted movies, music, or software).
- Attempt to reverse engineer, decompile, disassemble, or hack the App.
7. Intellectual Property & DMCA Compliance
We respect the intellectual property rights of others. Since the App functions as a browser, we have no control over third-party websites or servers.
- Copyright Claims: If you are a copyright owner and believe your rights are being infringed via our App, please understand that we cannot delete content from the internet as we do not host it.

8. Service Availability
We reserve the right to modify, suspend, or discontinue any service features at any time without prior notice to ensure the app’s stability and compliance. This includes adjustments to:
- Download mechanics and reset logic.
- Supported file formats and resolutions.
- Third-party service integrations.
9. Disclaimer of Warranties
THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Limitation of Liability
IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.
11. International Users
The App is controlled and operated from our facilities. Although the App is accessible worldwide, we make no representation that all features are appropriate or available for use in all locations. Users who access the App from outside China do so at their own initiative and are responsible for compliance with local laws.
12. Governing Law and Dispute Resolution
- Governing Law: These Terms shall be governed by and construed in accordance with the laws of the People’s Republic of China.
- Jurisdiction: Any dispute, controversy, or claim arising out of or relating to these Terms shall be submitted to the competent people’s court in Shanghai, China.
